This Privacy Policy describes how Prerna Kapoor (“Prerna”, “we”, “us”, or “our”) — a REALTOR® with REAL Brokerage serving the greater Denver metro area — collects, uses, and protects personal information when you visit prernakapoor.com or interact with Prerna’s services.

We take your privacy seriously. We only collect what we need to help you with your real estate needs, we never sell your information, and you can exercise your privacy rights at any time by emailing info@prernakapoor.com.

1. Information We Collect

Information you provide directly

  • Contact details — name, email, phone number, and optional notes when you submit a form (Free Buyer Guide, Free Seller Guide, Contact form, Callback Request form, or the site chatbot).
  • Property interests — neighborhood, price range, timeline, buying vs. selling, and any other context you choose to share.
  • Home valuation requests — if you request a home value estimate, the property address and any specifics you provide.
  • Chatbot conversations — the messages you type into Prerna’s Assistant and the replies it generates.
  • Email subscriptions — your email address if you opt in to marketing or newsletter communications.

Information collected automatically

  • Server and security logs — IP address, browser type, pages visited, timestamps. Used for spam prevention, rate limiting, and troubleshooting.
  • Cookies and similar technologies — see the Cookies section below.

CCPA / CPRA statutory categories

For California residents, the categories above map to the following statutory categories defined in the California Consumer Privacy Act, Cal. Civ. Code § 1798.140(o):

  • Identifiers — real name, postal address (for home valuations), email address, telephone number, IP address, similar identifiers.
  • Customer records information — name and contact information collected for use in real estate services (per Cal. Civ. Code § 1798.80(e)).
  • Commercial information — interest in real estate products and services (buying, selling, neighborhoods, price range, timeline).
  • Internet or other electronic network activity — pages visited, interactions with the site and chatbot, browser/device type, referrer information.
  • Geolocation data — limited to coarse location derived from IP address; we do not collect precise geolocation.
  • Inferences — drawn from the categories above, such as whether you appear to be a buyer, seller, or just researching.

We do not collect: characteristics of protected classifications, biometric information, sensory data, professional or employment information, education information, or genetic data.

Sources of personal information

We collect personal information from these sources:

  • Directly from you when you fill out a form, send a message through Prerna’s Assistant, send an email, or otherwise interact with us.
  • Automatically from your device (IP, browser, cookies) when you visit the site.
  • From service providers on our behalf (for example, Google reCAPTCHA returns a risk score for each form submission, and Brevo confirms whether emails were delivered).

Business purposes for collection

We collect personal information for these business purposes (CCPA § 1798.140(e)): performing services you request (responding to inquiries, sending guides, helping with real estate transactions), security and fraud prevention, debugging and quality assurance, internal research and analytics, complying with legal obligations including Colorado real estate record-keeping, and short-term transient use within the chatbot session.

Information disclosed in the past 12 months

In the past 12 months we have disclosed the categories above (identifiers, customer records, commercial information, internet activity, geolocation derived from IP, and inferences) to the service providers listed in Section 4 below for the business purposes described above. We have not sold or shared personal information for cross-context behavioral advertising in the past 12 months, and we have no plans to do so.

2. How We Use Your Information

  • Respond to your inquiries and help you buy, sell, or learn about Colorado real estate.
  • Send you the materials you requested (buyer/seller guides, market updates, listings that match your criteria).
  • Coordinate callbacks, showings, or introductions requested through the site or chatbot.
  • Send marketing and newsletter emails only to those who opt in — with an unsubscribe link in every email.
  • Process chatbot conversations through our AI provider (see Section 3) so the assistant can respond in real time.
  • Prevent spam and abuse (via Google reCAPTCHA and IP-based rate limits).
  • Meet legal, accounting, and real-estate record-keeping obligations.

We do not sell your personal information, and we do not share it with advertisers or data brokers.

3. AI Chatbot Disclosure

The chat widget on this site (“Prerna’s Assistant”) is powered by Claude, an AI model developed by Anthropic. When you send a message to the chatbot:

  • Your message and the relevant conversation history are transmitted to Anthropic’s API so the assistant can generate a reply.
  • Anthropic processes your data solely to produce the response. Per Anthropic’s current commercial API terms, inputs from customers like us are not used to train their underlying models. If those terms change in the future, we’ll update this policy and notify active subscribers.
  • The conversation is also stored in your browser’s local storage so the assistant remembers context across the session on your device; you can clear it any time with the trash icon in the chat panel.
  • Aggregate usage metrics (token counts, costs, model identifier) are logged on our server for up to 60 days to monitor costs and detect abuse — these logs do not contain your message content.
  • If the chatbot captures contact info you choose to share, that info is treated as a lead and flows through the same process described in Section 2.

4. How We Share Your Information

We share personal information only with service providers that help us operate the site and Prerna’s business, and only to the extent those providers need to perform their services. Our current providers include:

  • Hostinger — website hosting infrastructure.
  • Brevo (Sendinblue) — email delivery and marketing list management, including buyer and seller guides, newsletters, and transactional emails. Brevo stores your name, email, phone (if provided), and lead classification. Brevo Privacy Policy.
  • Anthropic — AI chatbot responses, as described in Section 3. Anthropic Privacy Policy.
  • Google reCAPTCHA — spam and abuse prevention on forms. Use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.
  • Gmail — outbound email delivery for lead notifications and autoresponders, governed by Google’s privacy terms linked above.
  • REAL Brokerage — our brokerage, which may receive contact and transaction information as required for real estate licensing and record-keeping.

We may also disclose information if required by law, court order, or legitimate regulatory request, or to protect our rights, property, or safety.

5. Cookies and Local Storage

We use a small number of cookies and browser-side storage items, mostly to make the site work or to remember your preferences. Specifically:

We do not currently run third-party advertising cookies or behavioral profiling. We may add privacy-respecting analytics (such as Google Analytics 4) in the future; if and when we do, this policy will be updated and prominent notice given before any tracking starts.

6. Your Privacy Rights

Do Not Sell or Share My Personal Information

Prerna Kapoor does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined by the California Consumer Privacy Act (CCPA/CPRA) and the Colorado Privacy Act (CPA). If that ever changes, this policy will be updated before any sale or share occurs, and a clearly labeled opt-out link will be provided.

In addition, we honor browser-based universal opt-out signals such as the Global Privacy Control (GPC) as required by the Colorado Privacy Act. If your browser sends a GPC signal when you visit prernakapoor.com, we treat it as a valid opt-out request for any future processing of your personal data for targeted advertising, sale, or profiling — even though we do not currently engage in any of those activities. You don’t need to take any additional action; the signal is honored automatically.

Colorado residents (Colorado Privacy Act)

Because Prerna primarily serves Colorado residents, the Colorado Privacy Act (CPA) applies to most visitors. You have the right to:

  • Access the personal data we hold about you.
  • Correct inaccurate personal data.
  • Delete your personal data, subject to legal record-keeping requirements.
  • Receive a copy of your data in a portable format.
  • Opt out of the processing of your data for targeted advertising, sales, or profiling (we don’t currently do any of these — this is a forward-looking commitment).

California residents (CCPA / CPRA)

California residents have parallel rights, including the right to know, delete, correct, and opt out of the sale or sharing of personal information (we don’t sell or share personal information in the CCPA sense).

EU / UK residents (GDPR)

If you are visiting from the European Economic Area or the UK, you have the rights described above plus the right to object to certain processing and to lodge a complaint with your local data protection authority. Our lawful bases are your consent (for marketing) and legitimate interests (for responding to your inquiries and operating the site).

International data transfers: Some of our service providers (notably Anthropic and Google reCAPTCHA) are based in or process data in the United States. Where we transfer EU or UK personal data to a country without an adequacy decision, we rely on Standard Contractual Clauses or another lawful transfer mechanism set out in those providers’ published data processing terms. You can request more information about our transfer mechanisms by emailing info@prernakapoor.com.

Authorized agents

You may designate an authorized agent to make a privacy request on your behalf. The agent must provide written permission signed by you, and we may still ask you to verify your identity directly before acting on the request.

Non-discrimination

We will not discriminate against you for exercising any of your privacy rights. We won’t deny you services, charge you a different price, or provide you a different level of quality of service because you exercised a right under CCPA/CPRA, the Colorado Privacy Act, or any other applicable privacy law.

How to exercise your rights

Email info@prernakapoor.com with your request. We’ll respond within 45 days (or 30 days for GDPR). To verify your identity before acting on a request, we’ll typically ask you to confirm information you’ve already given us (for example, the email address you used to sign up for a guide, or the phone number on file with Prerna). For requests about deletion or sensitive data, we may need one additional data point. There is no fee for exercising these rights, and we will not retaliate against you for doing so.

Right to appeal (Colorado Privacy Act)

If we deny your CPA privacy request, you have the right to appeal that decision within a reasonable period. To appeal, reply to our denial email or send a new request to info@prernakapoor.com with “CPA Appeal” in the subject line. We will respond to your appeal within 45 days. If your appeal is also denied, you may submit a complaint to the Colorado Attorney General at coag.gov.

7. Data Retention

  • Active lead inquiries and transaction records — retained for a minimum of four (4) years from the later of the completion of a transaction or last activity, to meet the Colorado Real Estate Commission’s record-keeping rules.
  • Email marketing lists — retained until you unsubscribe or request deletion.
  • Server logs — web server access logs, reCAPTCHA scores, and rate-limit data are retained for as long as our hosting provider keeps them, typically 30–90 days. We do not extract, archive, or store these logs separately for our own use.
  • Chatbot server-side usage logs — retained for 60 days (aggregate metrics only, not message content).
  • Chatbot conversations in your browser — stored locally on your device until you clear them or clear your browser data.

8. Security

We protect your information through HTTPS/TLS encryption, firewall-protected hosting, Google reCAPTCHA on forms, IP-based rate limiting, and standard WordPress security practices. No system is completely secure, but we take reasonable commercial measures to protect your data. If we ever become aware of a material security incident involving your personal information, we will notify you as required by law.

9. Children’s Privacy

This site is intended for adults interested in Colorado real estate. We do not knowingly collect personal information from children under 16. In line with the CCPA’s heightened protections for minors, we will not sell or share personal information of any consumer we know to be under 16 even if our general practices change. If you believe we have inadvertently collected information from a child, please email info@prernakapoor.com and we’ll delete it promptly.

10. Third-Party Links

The site may include links to external websites (for example, Zillow property listings, educational resources, or third-party tools). We are not responsible for the privacy practices of those websites. Please review their privacy policies before providing any personal information.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we make material changes, we’ll update the “Last updated” date at the top of this page and, where appropriate, provide additional notice (for example, via email to subscribers or a banner on the site). Your continued use of the site after an update means you accept the revised policy.
